What is WHMIS?
WHMIS (Workplace Hazardous Materials
Information System) is a Canada-wide system designed
to give employers and workers information about hazardous
materials used in the workplace. Under WHMIS, there are three
ways in which information on hazardous materials is to be
provided:
1. Labels on the
containers of hazardous materials
2. Material safety data sheets to supplement
the label with detailed hazard and precautionary information
3. Worker education programs
The Provincial Law, called
Bill 79 for Ontario, emended the Occupational Health
and Safety Act (OHSA), administered
by the Ontario Ministry of Labour applied WHMIS to non-federal
workplace in Ontario.
The Federal Law, called
Bill C-70, amended the Hazardous Products Act,
which allows manufacturers to protect their trade secrets without
endangering the safety of the worker, and amended the Canada
Labour Code which allowed WHMIS to be applied under
the Federal Labour jurisdiction.
Is WHMIS a law ?
WHMIS became law through a series of complementary
federal, provincial and territorial legislation that became
effective October 31, 1988.
Who enforces the WHMIS legislation?
In Ontario, Provincial Ministry
of Labour Inspectors enforce provincial WHMIS legislation.
The Federal Government,is enforced by Labour Canada Inspectors.
Both Provincial and Federal Governments enforce the WHMIS legislation. Regardless if your firm is a Provincial or
Federal workplace; The employer is to provide Whmis training, if you have chemicals in your workplace.
Remember you the employer must ensure the employee's safety on the job.
